Does your company manufacture, import or sell fishing gear containing plastic? If so, you may be covered by Extended Producer Responsibility for fishing gear.
EPR generally applies to the company that professionally manufactures or imports fishing gear containing plastic and markets it in Denmark. This also applies to distance selling to users in Denmark.
Responsibility therefore normally does not lie with the fisher or user who uses the gear, but with the party that places the gear on the market. However, non-industrial producers are exempt.
If your company manufactures fishing gear containing plastic, or imports gear from other EU countries or third countries and places it on the Danish market, you are typically covered.
If you sell fishing gear under your own name or trademark, the EPR obligation will often lie with you, even if the gear is manufactured by another company.
If a foreign company sells fishing gear directly to users in Denmark via a webshop or another form of distance selling, it may also be covered.
EPR applies to fishing gear that contains plastic. There is no lower threshold for plastic content. This means that gear does not have to be mainly made of plastic to be covered.
Plastic may, for example, be used in nets and lines, ropes and cords, floats and sinkers, or as plastic components in a composite construction. If the gear contains plastic, it may fall within the scheme.
You must register with Danish Producer Responsibility (DPA) no later than 14 days before you market fishing gear containing plastic for the first time. Fiskeriretur can guide you on what you need to have ready.
Each year, you must report the quantities you have placed on the market, in kilograms. Quantities must be reported separately for commercial fishing gear and other fishing gear. The deadline is 31 March.
You must ensure that end-of-life gear is collected and treated correctly. How this is handled in practice depends on the type of fishing gear.
