Then there is a high probability that you will be covered by the upcoming Extended Producer Responsibility (EPR) requirements for textiles. The exact Danish executive order has not yet been adopted. But the starting point is already clear: the scheme will cover the company that first makes the product available on the Danish market.
This means that manufacturers, importers, brands and companies selling directly to customers in Denmark should already consider how the rules may apply to them.
The scheme will cover companies that manufacture or import clothing, home textiles, footwear or related products and place them on the Danish market.
If you sell under your own name or trademark, the EPR obligation will generally lie with you - even if you do not manufacture the product yourself. How the obligation is allocated if you have taken over the right to sell another company's trademarks in Denmark will be clarified in the final Danish executive order.
Online sales do not change the EPR obligation. If you sell to customers in Denmark from abroad, you may also be covered once the Danish scheme is established.
The upcoming EPR requirements for textiles are not only about fashion clothing. The product scope is broad and will also cover companies with workwear, uniforms, interior textiles, footwear and certain leather and imitation leather products.
EPR requirements may also be introduced for mattresses as part of the national implementation. This has not yet been clarified, but it is worth keeping an eye on if your company operates in that market.
Although the Danish executive order has not yet been adopted, there are several things you can already start preparing.
You can map your product range and clarify which product categories fall within the scheme. You can begin structuring your data basis with your subcontractors, including quantities, weight and product categories. And you can take a closer look at your value chain: Who places the product on the Danish market - importer, brand owner or supplier?
The earlier you establish clear internal processes for obtaining the necessary data, the easier the transition will be once the rules are finalised.
